Change in name of Spouse/ Parents

(I)   Addition/deletion/inclusion of Spouse’s name

For addition/deletion of spouse’s name, applicant will be required to apply for new passport enclosing marriage certificate/death certificate/divorce decree, as the case may be, with the application.

Requirements:

A .For inclusion of Indian spouse’s name, in addition to the normal requirements,

   Original marriage certificate with a self-attested photocopy and self-attested photocopies of passport of the applicant’s spouse (original passport to be shown at the time of submission of application)

B. For inclusion of foreign spouse name, in additional to normal requirements,

   Marriage Certificate issued by the Indian Mission/Post abroad

OR

   Marriage Certificate issued by Foreign Government, duly attetsted/ apostile either by: (i) the Embassy/Consulate of India in the jurisdiction from where the marriage certificate was issued; or (ii) the foreign Embassy/ High Commission/consulate of that country in India;

OR

   Marriage Certificate issued in India by Indian authorities (Marriage Officer/ Registrar of Marriage)

OR

   Marriage Certificate issued by foreign Embassy/ High Commission/ Consulate of that country in India (to which the foreign spouse is a citizen)

C.Divorcees applying for a change of name are required to furnish the following, in addition to normal requirements:

   divorce decree authenticated by the Court (if the divorce decree is issued by a Dutch Court, it should be apostilled by the Dutch Ministry of Foreign Affairs, Deed Poll/Sworn Affidavit in the prescribed format (please see the link ‘Forms’)

D.In case of change of name following death of spouse, in addition to normal requirements,

   photocopy of death certificate of the spouse (original to be shown at the time of submission of the application) Deed Poll/Sworn Affidavit in the prescribed format (please see the link ‘Forms’)

E.Remarried applicants applying for change of name/change of spouse’s name will be required to produce the following, in addition to normal requirements,

   divorce decree (if the divorce decree is issued by a Dutch Court, it should be apostilled by the Dutch Ministry of Foreign Affairs)
   death certificate in respect of first spouse.
   marriage certificate from the Registrar of Marriages
   photocopy of present spouse’s passport (original passport to be shown at the time of submission of the application) .

   If the divorce decree or marriage certificate is issued by authorities (country) other than Dutch authorities, it is to be apostilled by the competent authority of that country or attested by the Indian Mission/Post in that country

Time Frame for service: Normally 1 month from the date of submission of application, if all conditions are met at the time of submission of application.
Note:  The applicant may be advised to submit additional documents, on case to case basis.

(II)     Change of parents’ name

Request for change in parents’ name will normally not be entertained. However, the following cases may be considered:

The parents themselves change the name (e.g., parent of a person after following the prescribed procedures changes his/her name and a new passport was issued in the changed name to the parent. Now the child of that parent is seeking change of parents’ name in his passport).

   There was some clerical error in respect of the parents’ name and an applicant provides documents proof showing the correct name (spelling of his parents(s)

   In adoption cases

There is no law under which a person, even the legal heirs of a deceased, can change the name of the deceased.

The name of step-parent can replace the name of father/mother in the passport of the stepchild only in the event of death of biological father/mother.

Request for deletion of parent name from passport due to parents’ divorcewill not be accepted. By virtue of the divorce decree, only the relation as wife and husband between the parents is annulled. The divorce decree does not result in severance of the relation between the child and the parent, unless the parent has legally disowned the child.

Time Frame for service: Normally 1 month from the date of submission of application, if all conditions are met at the time of submission of application.

Note:  The applicant may be advised to submit some more documents, on case to case basis.
